The general conditions define the dispositions relating to the use of the link service; Hereinafter referred to as: "service", which is intended for persons wishing to benefit from the services of a transport vehicle to a predetermined destination; these Persons are designated by the term "client", with a driver of a private car or a taxi car individually, or within the framework of a taxi company, having exclusively an operating license issued by the director of transport in the regionally competent jurisdiction, or who owns a private car, or who is authorized to drive a private car, hereinafter referred to by the term "driver", through FILAR Driver application, hereinafter referred to as "application "In the country of Algeria hereinafter referred to as "the country of service extension". The rights and obligations of the parties are also defined in this context.
These Terms are available both on the company's official website and on the application, and can be viewed, downloaded and printed anytime, anywhere.
The collective agreement for the use of FILAR Driver and FILAR Client applications contains 9 clauses, arranged as follows: 1- 1- Contractual Relationship; 2- General description; 3- Origin of the company; 4- Description of the Service; 5- Application’s operation; 6- Terms and conditions of registration in the application; 7- Price of the service; 8- Prices review; 9- Obligations of the contracting parties ; 10- Implementation dispositions
FILAR Client and FILAR Driver are affiliated with FILAR, a limited liability company, via an electronic platform bearing the name of FILAR, whose registered office is located at the following address:
Filar offers a convenient and efficient service that allows you to connect directly with a partner driver through their website or mobile application. The service is available in eligible country (Algeria)
To use the service, you must have a smartphone or internet-enabled device with a 3G or 4G or 5G connection. Once you have logged into the Filar app, you simply enter your destination to receive a fare estimate for your trip. If you wish to proceed, simply confirm your request by clicking the "request a Filar" button.
Using geolocation technology, your request is instantly sent to the nearest available Filar partner driver. Once a driver accepts your request, you can begin your trip with ease and convenience.
FILAR application is available on Play Store and Apple Store and Huawei Gallery, it is an application related to a platform that is managed by the company, as it provides a service that links the client with the driver in the country of Algeria and is described in the country of service extension where the client can request a driver after determining the destination and accepting the price of the trip and agreeing to the terms and conditions of the service, through the use of each of the parts, of a Smartphone connected to Internet line or a second, third or fourth generation Internet (2G/3G/4G/5G).
Any user who clicks on Accept button, is considered to implicitly accept all the conditions of this contract, and anyone who refuses to press the Accept button, will not be able to use this application or benefit from its services.
FILAR application for the Client : After downloading the application and the user accepts the conditions of use, the Client registers, using exclusively his personal phone number, his Facebook account or his Google account, then he receives an activation code in the form of a code composed of 6 symbols which are entered automatically or manually by the user, he then uploads his photo, his name and first name as an option, and he wears the entire responsibility to declare the validity of the above.
FILAR application for the Driver: After downloading the application and user consent to the application's terms of use, the driver fills in his personal
information, then car information, then downloads the following necessary documents:
Driver's license
Car insurance contract
Gray card
Criminal record
Technical control sheet
After that, the company alone has the right to accept or reject after reviewing the conditional documents, and the company does not accept any responsibility for any document that has suffered any counterfeiting of any kind, and the company does not bear also the consequences of noncompliance by drivers after the date of first registration, renewal of their documents and compliance with applicable legal dispositions.
FILAR application reveals certain information it deems necessary for both the client and the driver, so that both parties can get to know each other, such as the phone number, color and model of the car, and the company accepts no responsibility for any subsequent use of this data, whatever the results.
For the Client : The prices appear with the currency of the country of service extension, which is the Algerian dinar, in addition to the costs of providing the service, and the company can offer promotional offers or discounts which are exclusively deducted of the company's commission and can in no way affect the fundamental rights of the driver.
The company may review the price of the service in accordance with its profitability and marketing policy, and the driver will be informed of this review by one of the data; at least 48 hours before the entry into force of the new rates, and in the event of refusal, he must terminate his service and inform the company by contacting his head office or by his telephone, or by calling one customer service numbers, otherwise the driver will automatically accept the new prices
Any party using the service platform should recognize that the role of the business does not go beyond application mediation, between driver and client, and improving market quality of the transport in the country of extension of service, and this is what users understand and explicitly agree to.
A- Company obligations:
Free download of the application from Play Store or Apple Store;
Improving the quality of services by collecting driver and client data;
Provide a website for the general public to learn about the company's services;
Perform regular updates and checks to verify the operation of the application and its accessibility. The company also reserves the right to
The company declines its responsibility for any external circumstance of force majeure preventing access to the application for any reason or the loss of data of users of the service;
The company assumes no responsibility for losses imposed by market challenges
B- Driver's obligations :
Accept the client's transport request and do not prefer destinations for any reason;
Respect the general transport laws in the country of extension of the service and comply with the regulations, ethics and instructions imposed by the responsible ministry;
Update the data and information and recognize that it is real and does not contain any misleading character and the driver acknowledges that the data provided is proof of his identity and that the company has the right to distribute and use these data with his full commitment not to violate public order, public morals or the rights of other parties;
Use the service only in the authorized car, with the possibility of changing drivers if there is a replacement driver;
Do not harm the company's reputation and inform it exclusively of any emergency affecting the quality of service;
Collect payments from the client and do not burden the company with non-payment of the price of the trip by the client;
Maintain a decent and respectful appearance;
In the event of an accident of any nature, which obliges both parties to comply with the laws in force in the country where the service is extended, the driver informs the company only for information purposes.
In the event that the client forgets personal items, the driver will contact the client to collect his items, and in the event that he is not able to do so, the driver must contact the company, awaiting communication with the client to receive his articles from the head office, with proof of his identity and the publication of a report proving it;
In the event that a driver receives several bad evaluations, the company reserves the right to cancel his account without any compensation;
The driver has the right to assess the behavior of the client through the application;
The client has the right to cancel the trip within a maximum period of five minutes from the request, and in the event of negligence of the client when using the application, the company has the right to permanently cancel its account.
These collective conditions take effect as soon as the driver or client presses the Accept button
